ICE decides 4th amendment no longer applies too them

Administrative warrant is a real warrant. It's issued by the Department of Homeland Security and is specifically used to arrest illegals. Do your research.
The criteria are:

1. The person must have an existing deportation order
2. The person must have a criminal record

(1) makes the person a fugitive.

Harboring a fugitive debatably requires a judicial warrant. Depends where the person is being harbored.
 
ICE has decided on their own that the executive branch, on their own without any judicial involvement, can forcibly enter homes.

This is a clear violation of the 4th amendment and we’ve seen this in action in jurisdictions around the country.

The memo outlining the policy has been tightly controlled, clearly not wanting this information to get out.


This is the kind of constitutional violation that I think warrants criminal prosecution.

That warrant comes from an immigration judge, who is an employee of the executive branch. These do not come from article 3 judges and therefore the administration is usurping judicial power for itself.

If ICE agents have probable reason to believe there is an known criminal in a residence, as LAW ENFORCEMENT OFFICERS, they are entitled to enter the residence. I’m well aware immigration courts aren’t judicial. They’re executive.

Letting ICE force their way into a house based solely on an immigration warrant is the executive branch giving itself permission to violate the 4th amendment.

There’s no check and balance. SCOTUS made it pretty clear in Payton v NY that the judiciary is an appropriate check on the executive’s ability to execute a search or seizure.
