Texas was upheld by the Texas Supreme Court as conforming both to state and federal law and Constitution. Virginia's effort violated the state Constitution and was tossed by Virginia's Supreme Court for that reason.

Voting on something that would be unconstitutional but trying to bypass that anyway is a ploy. Welcoming legal challenges and winning in court would not.
