Arizona Shuts Down College Campus Free Speech Zones in the Name of Free Speech

Arizona has created two new laws that directly prevent State run colleges from restricting the 1st Amendment rights of the Students.

No more restricted off the beaten path "free speech zones" and the school must PROVE any restrictions they wish to impose on free speech are actually justified.

And the other law allows students to sue schools that do restrict their rights.
 
ā€˜But one year, ā€œall of a sudden they came up with this free speech zone which was way away from the people,ā€ the Republican told the Arizona Capitol Times.

That inspired Kern to introduce House Bill 2615, which broadens campus ā€œfree speech zonesā€ to the entire public college campus as opposed to designated areas. It provides students the right to exercise their First Amendment rights without concerns about the time, place and manner unless the public higher education institution can prove the restriction is reasonable and justified.ā€™

Wrong ā€“ ridiculous nonsense.

Just because a college or university designates a ā€œfree speech zoneā€ doesnā€™t mean a speaker must restrict himself to such a ā€˜zone.ā€™

If a speaker engages in speech outside of the ā€˜zoneā€™ and is subject to punitive measures by the state, then and only then does a potential First Amendment violation take place, where those disadvantaged are at liberty to file suit seeking relief, which is not the case here.

ā€˜ā€œThe First Amendment right of free speech is a bedrock founding principle of our Republic,ā€ said Gov. Doug Ducey (R) when he signed the legislation this month. ā€œLikewise, part of the university experience is to be able to express diverse views, openly, without fear of retribution or intimidation ā€“ and to be exposed to other views and perspectives, even if they arenā€™t politically correct or popular.ā€

ā€œThese bills protect free speech throughout our college campuses, and also ensure an individualā€™s right to engage in free speech isnā€™t shut down by someone else who disagrees with his or her perspective,ā€ Ducey added.ā€™

Until such time as government acts through its agent, such as a state college or university, to restrict or preempt speech, no First Amendment ā€˜violationā€™ has taken place.

Such measures are nothing but rightwing political theater, a ā€˜solutionā€™ in search of a problem that doesnā€™t exist, and ā€˜legislationā€™ thatā€™s nothing but a pointless waste of time, intended only to appease other ignorant conservatives.
