Biden DOJ Sides with Porn Industry's Lawsuit Against Texas's Age Verification Law

All it takes is one provision of a Law to get someone to object to it...

You can have one of the best laws ever legislated but if it has even one doubtful objectionable provision...

Somebody is going to fight it...

What substantive aspect(s) of this law do the ACLU and the DOJ and the so-called "porn industry" find objectionable? And why?

What they find objectionable is Texas wants you to provide your personal information and a credit card number or other means of identification.

How does that analogy work? These porn sites are clearly marked as porn sites and again, you are paying for daycare and getting an orgy in this scenario of yours. On top of the obvious child abuse that's a fraudulent business. This is more like consenting adults freely gathering to share their porn hobbie. If your child wonders into their gathering does your child become someone's else responsibility or is that your failure?
Okay, an absolutist view of the 1st Amendment would hold that the state cannot prevent the KKK from holding a rally on the steps of a school building when kids are in class. Consider this, however, we restrict and regulate the advertising of certain products which clearly violates that view. It is axiomatic, therefore, that the state can also restrict and regulate children's access to the pron industry's products.
You're arguing this to someone who watched a gathering of KKK members do just that. I watched a gathering of like 6 or so KKK members march by our highschool once. It was hilarious. :lol:

There has to be something better than a required registration process, but right now I am not coming up with anything.

I understand the desire for something like this, but the problem is one of implementation that doesn't overly burden people accessing this stuff legally.
Yeah, and as someone pointed out, minors get guns anyway and minors access porn anyway, even with regulations and laws. So, are we really accomplishing anything in passing laws to stop it, when it won't really stop it? Again, it's like guns. Felons aren't supposed to be in possession of guns but many, many felons get guns anyway, one way or another. The same goes for gun control laws. It just seems like we're over burdening legitimate and law abiding adults for not stopping the problem anyway. Hell, we have laws against speeding but have those laws stopped speeding?

I don't like using the "they will just do it anyway" argument. There is a legitimate societal reason for limiting porn access for minors.

One of the solutions I saw was to create a "XXX" website category to allow parents to screen those things out on phones and computers.

Of course it can be gotten around, but it would work on the vast majority of kids trying to access smut.

So instead of hamsterporn.com it would be hamsterporn.xxx. And programs could be created to screen those out.
 
Barrett sad it was difficult for her to do her job as a parent. Maybe she shouldn't have become one.

Kids will get around any requirements. The best way to deal with this is for the parents to deal with it.

I would pass along to her the idea that restricting first amendment rights of others because she doesn't want to do the work to monitor her own children is wrong.

But often enough to be worth the effort

Yes, I have an “idea.” My idea is that of course the Biden DOJ has not gotten involved in every 1A case in the last four years. It’s silly to pretend you don’t know.
I have no idea why any president wouldn't argue to defend the 1st Amendment.
How about to honor the independence of the judiciary? How about because this particular plaintiff has hundreds of millions of dollars to pay their attorneys to write their own briefs? How about because the 1A is not absolute and restricting minors from porn has always been legal under it?

But wire transfers to relatives of Joe will always Trump such reasons.
