The DOJ lacks authority to fine anybody.

It was the court that issued the fine.

The U.S. Court of Appeals for the D.C. Circuit rejected the Big Tech company's objections to an order that prevented the company from informing anyone about the warrant, according to a court opinion unsealed on Wednesday. Special counsel Jack Smith obtained a search warrant for Trump's Twitter account on Jan. 17, 2023.

Musk did not refuse to hand over anything. Indeed, he has already handed over the information. He was not fined by the DOJ, he was fined by the court that ordered the documents to be handed over. X was never against handing the documents over, just to the gag order that came with it....

Actually, whether ultimately right or wrong, Twitter’s objections were to the non disclosure order more than they were to the disclosure order itself. Twitter argues that it has a first amendment right to speak to its own customers and that the non disclosure order amounted to a prior restraint on free speech.

It did delay production even thereafter apparently because it couldn’t aggregate all of the Trump posts swiftly enough.

They hadn’t argued in time that the penalty formula was improper.

The government’s worries about the former President possibly destroying evidence if alerted to the warrant prematurely seems to assume that he would behave like Shrillary Clinton. I can’t explain why the 3 judges bought that nonsense.

They can fine Elon but is it contingent upon him to pay? And if he doesn't, what then, will they arrest Elon and put him in jail?

If Twitter owns Trump's tweets, then the Biden DOJ has no claim to them as it is neither Elon nor Twitter charged with any crime and those tweets can only be volunteered as evidence unless Twitter itself is criminally charged just for having them which they cannot or the court can specifically state what in them they believe is there in the commission of a crime and not just a fishing expedition, so if I were Musk, I'd tell the DOJ to go pound salt.
