It’s actually a pretty deep down legitimate concern regarding our very form of government:
If a court thinks it can “stay” Presidential decisions when the court is exercising a thin claim of “equitable jurisdiction,” then what would stop the Courts from acting as an unelected President? Doesn’t this constitute a threat to our Constitutional form of government?
Jefferson warned us about the judiciary, and in that vein he described the Judiciary as “the tyrannical branch.” We have a Constitution which separates the three branches for a lot of great reasons.
So why would it be wrong if Bove did say that? Can’t you conceive of a scenario where any President and Administration might actually need to consider it?
