I hope they will be banned from TV and magazine advertising. I worked in a medical support career for years and I vividly remember the first time I saw a pHARMa ad on TV -- thought it was an obscene joke.

First off Congress needs to ban lobbying from big corporations, including pharma, and involving government never seems to turn out well, I can see work around, bigger companies get stronger, R&D going downhill, small pharmaceuticals going away. It seems government corrupts.
Lobbying is something that needs to be talked about in D.C. and to us the people.

As long as Congress has the power to destroy a business or industry with capricious regulation, businesses and industry will find a way to influence Congress.

Good point, then what do we do? It talks about prices getting in alignment with other countries pricing, the US operational costs are higher than other countries, and also what about standards, some countries standards are lower than ours.

We often sell last generation drugs to other countries. I know that for many years, that was true in Canada. If you got cancer....you were not getting the most up to date. That is how they kept costs down.

It doesn’t matter what you or I think. The issue is what the Constitution says.

We all already know (or should know) that a President gets some powers delegated to him by Congress not created “law” but rather to ADMINISTER what Congress has authorized. And a President also has his own Constitutional authority on many matters. As to those matters, he can issue proclamations or orders as he deems appropriate (within the confines to f Constitutional authority).

My question is whether a Congressionally passed law delegates this matter to the Executive Branch. I know that arguments can be made — one way or the other. But I can’t identify what Constitutional granting authority covers this.

I’m willing to consider any such argument. But for now, I don’t see it.
