The first 31 charges are about knowingly retaining national defence documents he doesn't own. Trump, Biden or Pence didn't pack the documents which ended up under their possession, a federal employee did. There is no place we can find where Trump, Biden or Pence asked for national defence documents to be taken.

So Trump is not being charged for taking these documents and being in possession unknowingly.

The problem is Trump admitted that he knew these documents were under his possession. He said on TV that he owned them (which he doesn't) and he then hid them from the US Government and then lied about having them
