WASHINGTON — The Supreme Court on Wednesday agreed to decide whether former President Donald Trump can claim presidential immunity over criminal election interference charges, adding a new hurdle to a trial taking place.

The court in a brief order said it would hear arguments and issue a ruling on the immunity claim. In the meantime, the case is on hold, meaning no trial can take place.

The order said the court would hear the case the week of April 22.

The case could take months to resolve.

Even if Trump loses, the trial would not take place until well into election season. If Trump were to win in a ruling, the charges would be dismissed.

The Supreme Court, siding with Smith, contrary to team Trump was the correct way to go, as arguments in April could give a ruling in June, so trial could be before the election on the J6 charges, as well as the Georgia case, the appellate refused to block.

Trump’s lawyers say that presidents should have total immunity for official acts as president and that his actions in questioning the election results were part of his official duties. Among the legal questions lurking in his case is whether Trump’s attempts to interfere in the election constitute official acts.

If I were to take a purely partisan stand I'd say 'SCOTUS should've punted' because doing so would not have postponed the trial of the century, where Trump is being charged with election-obstruction.

But this is bigger than Trump and his pathetic attempts to steal the 2020 election. SCOTUS made the correct decision.
 
It's all about Trump. If found guilty there will be no way the Republicans can turn to an alternative that late.
No it is not. This one is about far more than Trump. It's a constitutional issue that could very well show up again, sooner than later as teh genie has been let out of the bottle.

The former president had complained in a filing to the high court that, absent a delay, he would quickly find himself facing a trial, which would interfere with his campaign to win back the White House in November. He has been arguing, thus far unsuccessfully, that all actions he took while president have immunity from prosecution.

Special counsel Jack Smith, in his response to Trump’s request for a stay, said that Trump had no legal right for more delay, and that the nature of the case — a former president accused of committing multiple felonies as part of his scheme to remain in office despite losing reelection — made a speedy trial of great importance for American democracy.

He could seek ..

and... "attempts to interfere in the election constitute official acts" is a big one, but not the only issue that hopefully will be decided.
 
USSC judges have eyes and ears as to goings on. This will be a quick 8-1 favoring Trump and then quickly but…but…followed by another indictment from scums

How in the world could anything think that Trump has "immunity" from leading an insurrection against the United States in an attempt to overthrow a presidential election to illegally keep himself in power. The voters chose Biden - not Trump.
