SCOTUS will hear Trump's IMMUNITY claim over criminal election interference charges

WASHINGTON — The Supreme Court on Wednesday agreed to decide whether former President Donald Trump can claim presidential immunity over criminal election interference charges, adding a new hurdle to a trial taking place.

The court in a brief order said it would hear arguments and issue a ruling on the immunity claim. In the meantime, the case is on hold, meaning no trial can take place.

The order said the court would hear the case the week of April 22.

The case could take months to resolve.

Even if Trump loses, the trial would not take place until well into election season. If Trump were to win in a ruling, the charges would be dismissed.

This should be a no-brainer - but we'll see. Another stalling tactic for Trump. What do you think?

If Trump is not immune, Katie bar the door!

Biden is criminally liable for every Fentanyl death, all the child and human trafficking and all the crimes committed by the new base of the democrat Party: the Illegal Alien Invaders that Biden Administration worked so hard to bring to the USA

Idiot Democrats in Congress took far, far too long to refer the matter to DoJ.

Idiot bureaucrats took far, far too long to formalize the charges and present the evidence to a grand jury.

I blame the Democrats for this fiasco.

Honest-to-Christ, these LibProg Dem idiots would screw-up a two-car funeral...

The only thing worse is an idiot MAGA-Pub cultist... a True Believer...

I believe it's another stalling tactic. After they deny him immunity he will then try to get the trial delayed until after the election because "it's too close".

OTOH, if they do give him immunity I hope Joe BIden takes full advantage of it and ships his ass off to guantanamo for being an enemy of the state.

In all practicality, presidents are immune while in office....

  • They can pardon themselves and others for federal crimes except for impeachment.
  • They probably make the call on most assassinations. There are collateral casualties.
  • The DOJ reports to the president
  • Biden would have been indicted by now otherwise. :)
From Forbes:
The DOJ has long held that presidents cannot be criminally indicted while in office—arguing in a memo it “would impermissibly undermine the capacity of the executive branch”—and the Supreme Court ruled in Nixon v. Fitzgerald that presidents can’t be held liable in civil cases for actions they undertook as part of their official duties, though the high court separately found in Clinton v. Jones that presidents can be sued in civil court for actions taken before they were president.

So, if they are immune while in office, how can you possibly charge them for things while they were in office? Why would we allow them to commit crimes we would charge them for later? Makes no sense to me.

Removal from office is solely by impeachment and conviction by the Senate.

Presidents have immunity, I think.

Jim

Biden could always take the moron to Fifth Avenue...

SCOTUS has come to an informed consensus.

The American electorate must make a decision on Trump, and that can only be done by election.

Thus, SCOTUS will not grant rejection from candidacy.

Thus, SCOTUS will not recognize immunity.

We the People must make the decision.

He can be convicted in any or all trials, but he can still serve.

It is up to We the People.
