Let this be a lesson to all of you: Be careful what you do out of your hatred, because you could be breeding the very thing you hate.

If Democrats don't want to be labeled as commies, they need to avoid acting like commies. They're going to breed a new generation of Randians if they start embracing nationalizing patents.

This is 100% the wrong approach. Patents have to be honored. If the duration of patents is too long, then push for legislation that changes the duration. The playing field must be equal. At the very least, if they want medications to have a shorter duration, then put it into legislation. That, at least, would be an honest, over the table approach that would allow the manufacturers to decide whether the investment is worth the pay-off. Better yet, if they feel the greater public good so severely needs access to these medications, then the federal government should fund the research and development directly. This, again, would at least be an honest approach. But if Biden does this in this way, it's nothing short of theft.

The Biden administration has determined that it has the authority to seize the patents of certain high-priced medicines, a move that could open the door to a more aggressive federal campaign to slash drug prices.

The Biden administration has determined that it has the authority to seize the patents of certain high-priced medicines, a move that could open the door to a more aggressive federal campaign to slash drug prices.

The determination, which was described by three people familiar with the matter, represents the culmination of a nearly nine-month review of the government’s so-called march-in rights. Progressives have long insisted that those rights empower the administration to break the patents of pricey drugs that were developed with public funds, in an effort to create more competition and lower prices.

The administration will not endorse the widespread use of march-in rights
, and is not expected to take action against any individual medicines, said the people familiar with the matter, who were granted anonymity to discuss internal decision making.

Instead, the Commerce Department on Thursday plans to issue a new framework spelling out factors that federal agencies should weigh in determining whether to take march-in action against expensive drugs or other individual products that were created with federal help. The price and availability of that product to the public are among the factors the department will recommend that agencies consider.
The department will seek public feedback on the framework, which is likely to face sharp opposition from pharmaceutical companies that argue it’s illegal for the government to seize its patents and would disincentivize the development of new drugs.

You went full bullshit. Never go full bullshit.

Rand is an idiot. Patents have no place in free market capitalism. They are nothing more than government supported monopolies. Try reading a real libertarian philosophers work like Bastiat's Sophisms of the Protectionists or The Law.

I don’t agree with seizing drug patents but don’t agree with extending them indefinitely either
There is no reason Insulin should cost so much

No.

Actually, that is entirely false. A patent is an exchange. The inventor enables other people to duplicate her invention, in exchange for temporary exclusionary rights. This promotes publicly useful ingenuity by:
  1. creating economic incentives because the inventor is guaranteed a certain amount of opportunity to exploit the invention for profit, AND
  2. ensuring that the invention will become public domain within a reasonable time and that reasonably skilled individuals can duplicate the invention by using publicly disclosed information from the inventor.

The alternative would be for inventors to withhold the information necessary for duplication, which could prevent others from being able to replicate the new technology effectively for a much longer period of time. Of course, if they decide to do this, they risk someone else independently developing a nearly identical technology, or someone simply reverse engineering their technology, thus diminishing the reward for their R&D efforts.

Patents are an exercise of private law. An inventor is not required to obtain a patent. They could hoard the information forever if they wanted to. It's a choice an inventor makes. They weigh their options and choose to give up one valuable opportunity for another.

Patents are, therefore, the very essence of free market capitalism.

pharma research in the usa is mostly funded by our government. why we allow these corporations to profit from them is a capitalist artifact.

GREAT news - thank you! :)

First off, we shouldnt be funding research and trials and such for companies. Much less multi billion dollar companies.
Second, since big daddy gubmint has to put its filthy, corrupt hands, in every fucking thing, they should at least control the prices of these meds.
This is NOT capitalism.

actual inventors hold few modern patents. most intellectial property belongs to the inventors employer by contract.

It's not our fault that young people are more open to socialism than ever before. Maybe Capitalism isn't working?

No one is pushing for communism. That's just silly talk.

You're an idiot. A patent is a business using the force of law to prevent competition. It's the philosophy of scarcity. As I said, try reading a libertarian philosopher rather than a bad fiction writer.

Because of price controls, like I described.
Why do other countries get the same drugs for much cheaper?
They also spend less per capita and have better health outcomes across the board.

But hey, rich peope can jump theline and get better care in this country.

And for some reason, 75 million not rich right wingers think that is the picture of perfection. "Best Healthcare in the planet!"

Because their handlers have them caring about and voting on trannies in bathrooms and abortions and scary brown immigrants.

Why do other countries get the same drugs for much cheaper?
Stormy Daniels winger has a good question that approaches the nature of capitalism. for capitalism to operate we must negotiate a price. i lose standing to negotiate when i lose consciousness. the emergency room is a hell of a place to negotiate the price of intensive care.
