WTH?!? Most Racist Supreme Court Ruling Since Plessy — Greenlights Racial Profiling in ICE Raids

And many left NAZI Germany, and came to America for that very reason.
Many business people and tourists from Hispanic countries are avoiding visiting the U.S. for this reason.
They are afraid of being scooped up in an ICE raid or being harassed

Actually the court's shadow docket ruling said just that.

There was an order preventing ICE from detaining people based on the four criteria ICE was using.
The court put a stay on that order, allowing ICE to detain people based on the four criteria.

The order halted the raids, with Judge Frimpon saying the Trump administration cannot rely on factors like "apparent race or ethnicity" or "speaking Spanish" alone to stop or question individuals.

Good to know. But of course, I never said otherwise and neither did the decision.

Reasonable suspicion does, however, authorize a police/civilian interaction to seek additional information.

For example: You must identify yourself in states with “stop and identify” laws Hiibel v. Sixth Judicial Dist. Court of Nev., Humboldt Cty., 542 U.S. 177 (2004)


Interestingly, a refusal to comply in such a state can be grounds for an arrest. But that’s not at issue, here, since we aren’t discussing “arrests.”

California isn't one of those states.

SCOTUS did the right thing. Those who entered illegally have to go.

I know. And that’s why I already differentiated between states which have that law and those which don’t.

But it doesn’t matter because that rule only says that refusal can be grounds for an arrest in those states. It doesn’t deny law enforcement their ongoing authority to ask.

If, in the process, there arises additional information amounting to probable cause for an arrest, then the police may still make an arrest.

But taking an illegal alien in (under detention for removal proceedings) isn’t the same as an arrest, anyway, since it isn’t a criminal matter.

The court giving such direction would have to be within where they wanted the 4th amendment to stand. If they said ICE could use racial profiling, that would hold for other stops and detentions.

Which would allow the police to stop every white male, when they get a report of a white male committing a crime.

Which would outrage the MAGA base.

So there are more Canadian illegals, than there are Mexican illegals.
