While in New Mexico DO NOT CLENCH your buttocks

And when government breaks the laws...they will pay

Really?

Do you think the doctors, or the cops, will go to jail over this? Do you think they will even lose their jobs? If not, who the fuck do you think will actually pay? Could it be the taxpayers?

HOW THE FUCK DOES THAT MAKE SENSE?

Yup

Those cops represent you Mr and Mrs Taxpayer. When they screw up....you pay
What do you do? Take it out on the Chief of Police who authorized a search in direct violation of the Constitution. Take it out on the cops who exceeded their authority.

That is not what I do, that is what stupid idiots that think the government is controlled by lawsuits do.

I bet Arronland is not stopping at every stop sign he can find

I heard about this. This is an absolutely disgusting abuse of power by the police. I hope they all end up unemployed. With this hanging around their necks, they won't be able to get a job as a Wal-Mart security guard.

This story is disturbing to say the least.
For this to be taken to such an extreme for a minor infraction is unthinkable.
It serves as an indicator of the status of the ordinary American citizen vs the law-enforcement bureaucracy. These cops obviously believed, as did the medical professionals who cooperated with them, that it's okay to do this to someone.

Even if they did find drugs in his intestines, the way they went about it is absolutely unacceptable according to standards of civilized conduct. If someone's life, or if preservation of state secrets, depended on what could be discovered by such drastic measures, then the actions would be justified. But suspicion of concealed drugs. . .?

Is this what Ronald Reagan had in mind when he expanded and intensified the drug war?

Let's face it.If you get pulled over by the police you are in big trouble.
They will do whatever they can to "find" something they can nail you on.
No doubt they will at least find something to give you a ticket for.
If they can come up with a reason to arrest you, they will.

The police after making you pull over will probably be in trouble with their
Capt.if they just let you go.
They are in trouble if they don't meet a certain quota for tickets and arrests.

The incident began January 2, 2013 after David Eckert finished shopping at the Wal-Mart in Deming. According to a federal lawsuit, Eckert didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.

Eckert's attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks. Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity. While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.

The lawsuit claims that Deming Police tried taking Eckert to an emergency room in Deming, but a doctor there refused to perform the anal cavity search citing it was "unethical."

But physicians at the Gila Regional Medical Center in Silver City agreed to perform the procedure and a few hours later, Eckert was admitted.

What Happened

While there, Eckert was subjected to repeated and humiliating forced medical procedures. A review of Eckert's medical records, which he released to KOB, and details in the lawsuit show the following happened:

1. Eckert's abdominal area was x-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

7. Doctors then x-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.

Throughout this ordeal, Eckert protested and never gave doctors at the Gila Regional Medical Center consent to perform any of these medical procedures"

Story update!

A New Mexico man was awarded $1.6 million after an overdose of anal probes.

David Eckert sued Hidalgo County and the city of Deming saying cops ordered eight different anal probes during a nightmare traffic stop last year.

*snip*

But Eckert filed a lawsuit in November and in just a month, both the city and county, in southern New Mexico, were ready to settle.

But he's not done yet! This party's just getting started!

Eckert still has pending suits against a deputy district attorney who signed off on the intrusive search warrant, the doctors who performed the search and the Gila Regional Medical Center, the facility that hosted the exams.

*snip*

Among the violations was the fact that the search warrant for the exams was valid only in Luna County, but he was taken to Grant County after emergency room doctors first refused to do the exams on ethical grounds. He was also denied the right to make a phone call from the police station.

I'm glad this guy is getting justice. I have no idea the employment status of the cops and doctors involved in the incident. Hopefully the cops are unemployed and the doctors stripped of their licenses

Just saw that. Nice settlement from the county, but the best is yet to come for this guy. It's going to cost the hospital about ten times that amount I would imagine.

Hard to deny, after reading all the above.
Although, it was only one incident, in one county, in one state...so I guess the whole of the USA and all the People of it can't be held responsible.

Except it is actually multiple incidents, in multiple counties, in multiple states.

Wouldn't go as far as banana-republic police state, not all law enforcement agencies are equal afterall. But they definitely violated his federal civil rights. They should be sued, loose, and be fined so much they don't wanna go on living.

Except it is actually multiple incidents, in multiple counties, in multiple states.

How so?

There are two more cases from the same county working their sway through the system right now.

It also happened in El Paso.

Woman sues over vaginal, anal exams in El Paso drug search - El Paso Times

I can keep going, but you will just come up with excuses.

I was just wondering, as it seemed from the story to be only one county in one state.

This is fucking horrific! I would be hard to believe had I read it in a history book about Nazi Germany or Stalinist Russia. My God, what has become of our individual liberties?

There is no amount of compensation that makes this acceptable. The cops, the judge, the doctors should all do serious time in prison. Ain't likely to happen, but my God...I'm speechless!

War on Drugs must be won. Got to break a few eggs to make an omelet you know.

War on drugs is one thing...but what happened to this guy is a total outrage.

In my non-US state;

Police powers | drug info @ your library

If internal concealment is suspected

People reasonably suspected of internally concealing a suspicious substance may be detained by a customs officer or police officer. The chief executive officer of Customs or a police officer must then seek a detention order (up to 48 hours, but renewable) from a judge or magistrate. If the person detained does not consent to an internal search, the customs or police officer must apply to a judge for an order for a medical practitioner to carry out the search.
