They are breathing, they're just not breathing air. Let's put it this way, we have technology that allows people to breath highly oxygenated fluid now. Do we say they stop breathing just because they're not breathing air?

Breathing literally means taking in air and expelling it from the lungs.

Roe v wade and Casey S.C. decisions had determined the mother's choices were hers to make, until the baby to be could survive outside of the womb, which at the time was about 24- 26 weeks. Since the development of tiny tiny needles for premature infants to administer medications and fluids, a baby can some times survive at 22 weeks now, though chances of survival outside the womb are very low, but occasionally possible.

Casey case ruled it was none of the governments bees wax, until the fetus was considered independent of the mother's body to survive...and then the state govt could impose laws or rules if they wanted to.
