Once South Carolina, or any other State seceded, they were out of the Union. Treason only affects those that are part of that Union. Any war levied against the North by the South was War, not treason.
And, secession is not treason. And the South seceded peacefully. Each Southern state passed it's secession. Each Southern state submitted the reasons for it's secession to congress. And then walked away. The South did not rise up and make war with the North to secede. She seceded peacefully. The North in turn forced the War, Lincoln especially, refusing to let the South go.

Lee's oath to the Union was null and void once Virgina seceded. Lee wasn't a traitor. Just like Jeff Davis was not a traitor. Just like the South was not traitor. The North was the only traitor in that War. Glory, glory, hallelujah...
