Trump admits documents were not declassified

Trump was invited to testify before The J6 Committee.
He refused.
They were willing to have him talk to trip him up, but he had not ability to defend himself properly because it was not a court of law, rather, it was a Star Chamber.

Trump's lawyer is telling him not to say a word about things, or end up in jail for the rest of his life

So now he must try and defend himself before the election without talking

This was by design.

Where did you come up with this?
Trump doesn't need to follow any formal protocol. But he admitted on tape that the document in question was not declassified.

The courts said that he needed to have some proof that they were declassified, so....Trump loses....
You just shot yourself in the foot 3 times. Read these three things that your own link says:

1st shot in your foot:
"However, presidents generally follow an informal protocol when declassifying documents, Richard Immerman, a historian and professor at Temple University, told VERIFY.
First, the president will consult all departments and agencies that have an interest in a classified document. Those departments or agencies then provide their assessment as to whether the document should stay classified for national security reasons. If there is a dispute among the agencies, they debate, but the president ultimately makes the decision on declassification, Immerman explained."

2nd shot in the foot, your article says the declassification of a document doesn't absolve Trump of a crime:

So to the extent that he [Trump] had any nuclear information in there, declassification would not help him in the slightest, because he would still be disseminating restricted data or moving Restricted Data,” he added." I don't think you read your own article.

You just gave me an article that says moving nuclear related documents is a crime regardless of classification status.

3rd shot in the foot: Trump said in Truthsocial that all documents were Declassified, knowing that no one can rely on his mind and memory for the status of documents:

"In a post on Truth Social, his social media platform, Trump later claimed that the documents were “all declassified.” Kash Patel, who served as chief of staff for the acting defense secretary during the Trump administration, also claimed that Trump had declassified the documents."

Non story as even our current President kept classified documents in an open garage, Hillary thousands of emails on a private server. This is a one sided witch hunt by a sitting President. Our country is becoming a huge turd

Trip him up?
How so?
You'd better check your basic knowledge of civics and American government.
Duly appointed congressional investigative committees are certainly legitimate and legal and yes, their authority carries the weight of law.
It is true they did not have the authority to officially charge Trump with the crimes that their investigation uncovered.
That was not the mission or the objective of the committee.
It's purpose was to inform the American people of what actually took place on Jan. 6th 2021 and Trump's role in the insurrection and attempted coup against American democracy. Also the investigation was important for the history books and the official congressional record.
As for the "legal" charges associated with the committee's investigation that will be up to The Department of Justice and The U.S. Attorney General.
Special Prosecutor Jack Smith requested any and all evidence in the possession of The January 6th Committee last year.
The committee's job is done.
Now the ball is in AG Garland's court....to charge or not.
It is doubtful he will need to though with Trump already facing 37 other, seperate, felony charges that are likely to put him away for the rest of his natural life.

1. 1st shot: Hanging your hat on words like "generally follow" doesn't prove anything against Trump.
2. 2nd shot: Prove "intent". Trump didn't pack the boxes.
3. 3rd shot: If Trump declassified those documents, they were declassified. Prove they weren't.

Jack Smith will prove it.
If he did not have the evidence to prove it he wouldn't have filed the charges.

1st shot: along with the operation crossfire hurricane which you have mentioned in the past regarding this issue. Trump had them reviewed and publicly announced declassification. now you're claiming that all of a sudden he switched to telepathy. Good luck selling that to a jury.

2) since you're the first person in this universe who has made this stupid "Trump wasn't holding the tape gun" argument, I won't even bother.

3) Trump said they were Declassified, so he's going to have to prove it, not me.
I'm not the indicted one.. He is.

Do you any proof that Biden lied for over a year to keep those documents, and plotted and directed his people to hide them from the Feds?
Why the distraction? Biden illegally took and kept classified documents from the Senate and from the White House.

1. The point is that there is no formal protocol for a president to declassify documents

2. You and Jack Smith can prove that Trump intended to take every paper that was packed into those boxes?
Remember: Hillary paid for her illegal bathroom server, but had no "intent" to break the Law?

3. Innocent until proven guilty, Smith needs to prove every count.

1) declassifying with the mind is not a thing, so therefore, it’s not formal or informal, because the document would still bear a classified marking. No president ever declassified a document that retained its marking as classified. You can try naming that President if you want though.

2) Trump isn’t even making that argument.

3) Duh.
