It’s the part of the amendment that literally allowed slavery and involuntary servitude to continue across the country, on plantations and within the barbed-wire fences of prisons. Scholars and prisoners’ advocates argue that its impact is still felt today through prison labor.
Here’s the full wording of the amendment:
“Neither slavery nor involuntary servitude,
except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction” (emphasis ours).
