They have. Also I've been telling my senators to do this for years, Kagen and Sotomayor should have never been confirmed. Judges are supposed to apply the law and Constitution as written. It's not their job to find ways to uphold defective legislation, it's not their place to rewrite laws. Any judge that thinks that is their job should never be nominated for the high court.
Funny thing, that "judicial activism", it's always on the "other" side.
Yeah, except when the person criticizes equally. If I think a judge gets it wrong, I will say so no matter who it is. Even Scalia didn't always get it right, usually in cases dealing with the interstate commerce clause.
