No, Trumps magical wave your arms and everything is declassified is not going to cut it.
Nothing magical no arm waving. Just his say so. And it will suffice legally despite your consternation or disbelief. Here’s a telltale sign.

Suppose our idiot President directs his malignant AG to seek an indictment against the former President charging him with crimes connected with the Espionage Act. If he gets so indicted and if the case doesn’t get dismissed ahead of time, at a trial Patel would testify all about the President’s directive. Now, since the Government has the burden of proof and it can never be shifted on to a defendant, guess what? That’s right! The US Attorney will have the burden of proof beyond a reasonable doubt to DISPROVE the declassification.

This is why there is a very good chance that even our imbecile President’s inept handlers will refrain from seeking such a charge. And although they can pretend to proceed with other charges, none of those are of any merit or value.

Actually Trums public statements of having declassified the documents means ABSOLUTELY NOTHING.

Trump has to make that claim under oath, under penalty of perjury, before it can even be considered.

Until then it's no different than Trumps public statements that he won the 2020 election.

I assume he will repeat that he was present when President Trump gave the standing order.

None of that meets the government’s burden of proof. Nothing they can ask at all will meet that burden. But, tough luck for any unfortunate US Attorney. The Government retains the burden of proof despite that fact.
