Rep. Massie Debates Iran War Powers Resolution

The "War Powers Act of 1973," is unconstitutional. But Trump still hasn't met the requirements. And neither have the other recent presidents since 1973.

War Powers Resolution (50 U.S.C. § 1541(c)), which was enacted in 1973 to limit the President's ability to commit U.S. forces to hostilities without congressional involvement. Specifically:
  1. Declaration of war by Congress: This is the formal constitutional mechanism under Article I, Section 8, where Congress explicitly declares war.
  2. Specific statutory authorization: This could include laws like an Authorization for Use of Military Force (AUMF), such as those passed after 9/11 for actions against al-Qaeda and associated forces, or for the Iraq War.
  3. National emergency from an attack: This covers defensive responses to direct attacks on the United States, its territories, possessions, or armed forces—essentially allowing the President to act unilaterally in immediate self-defense without prior approval.
When was it declared unconstitutional?

what part of the constitution says they can't?
AGAIN, you dont understand the constitution.
It doesnt say the president can shoot 4th graders visiting the lincoln memorial. Does that mean he can?
The constitution states the fed govs power. Anything else is left to the states. It is a RESTRAINT on the gov. Your leftist view that they can just do whatever they want, if it doesnt say they cant, is a complete load of bullshit.

Congress has no authority to delegate away its legislative powers. Which is what the WPA does. Thats what AUMFs do.
The constitution is quite clear. Only congress has the ability to declare war.
<~~~~~~~~~~>
No one has ever contested that fact.
Yet, Presidents like Truman, Kennedy, Johnson, Reagan, Bush 41, Clinton, Bush 43, Obama, Biden and Trump have all used our military to war on others.
Some presidents more than others....

I know it hasnt. And it should.
We do have Thomas Jeffersons input on it and he said congress does not have the authority to delegate it legislative powers away to another branch. They made the 3 branches of government, with specific powers, for a reason.
Our government is lazy as hell.

Can you imagine if Congress would been required to declare war before the invasion of Panama?
Congress would still be discussing the why's and wherefores today..

Since the War Powers Act, we’re dramatically poorer as a nation, off the gold standard and $39 T in debt.

15th post
It gives the power of declaring war to congress. Not the president. Not a gang of 8. Not a few senators giving their thumbs up.
And the WPA, AUMFs etc are unconstitutional. Congress doesnt have the authority to delegate its legislative powers.

Sure, but I am complaining about how its so bad, people deny reality. Its not good or healthy.
