The law states a person must be an imminent threat to cause serious bodily harm or death. That was not the case here. He was unarmed and being subdued by 4 agents. Where is the imminent threat.

Actually he did say that. Pointing out the difference betwen legal carry and whether he was smart in bringing the weapon.

But attempting to apply it was "careless and dumb" is a red herring as it does not impact events at all. Pretti never brandished his firearm, nor did he ever reach for his firearm before or a after being scrummed by ICE.

He was not an imminent threat after he was disarmed. One must be an imminent threat to allow use of deadly force. He didnt have a gun when shot. Thats the issue

Yet Byrd walks free with no repercussions to this day.
