3 shots were fired. The 1st round went into the front windshield from an angle rather than from the front of the car. There was only one bullet hole in the windshield, so the last 2 rounds were fired from the side of the car after it went by the shooter, meaning that he ain't in any imminent danger at that point. Forensics will tell us which of those 3 shots were fatal, BUT I believe the shooter is responsible for all 3 shots. I seriously do not believe the shooter was in imminent danger of death or serious injury to begin with, but especially not the last 2 shots and if one of them was the fatal shot then he could be charged with a homicide to some degree.
