Actually the amended version makes it absolutely clear, the VP has to open up certificates, even if they are obviously phony. He has to present them to congress, and congress decides what to do with them.Didn't you say he could just not open the the certified votes of a state and send it back to the states. Neither the Constitution nor the statute gives him that authority.
In fact it now says:
(2)Powers explicitly denied.—
The President of the Senate shall have no power to solely determine, accept, reject, or otherwise adjudicate or resolve disputes over the proper certificate of ascertainment of appointment of electors, the validity of electors, or the votes of electors.
