Crossing the border is only illegal if and when the immigration judge proves / decides you aren't seeking it. Then you've committed an illegal act and are sent back. Most are accepted , in our entire history only 2 - 3 % were ever sent back. Remember all those Cubans and the Coast Guard was trying to stop them from reaching U.S. soil.
