Crossing the border is only illegal if and when the immigration judge proves / decides you aren't seeking it. Then you've committed an illegal act and are sent back. Most are accepted , in our entire history only 2 - 3 % were ever sent back. Remember all those Cubans and the Coast Guard was trying to stop them from reaching U.S. soil. Once they reach it ,they have rights under our laws. That's one of the signatures of a free nation. We are not a dictatorship or fascist state.
