The Supreme Court agreed and the US Court of appeal in 4 different cases agreed.
Due process, for the vast majority of deportees, for almost 30 years, has been a review/decision by an INS/DHS/ICE officer, with no judge, no lawyer, and no appeal.
Trump has met the same due process burden met by both Obama and Clinton.

The only people debating this are Democrats who want to keep illegal aliens in the US.
 
Due process focuses on the procedures the government must follow before taking action that affects someone's life, liberty, or property. It requires adequate notice, an opportunity to be heard, and a fair and impartial tribunal.
Except when Clinton and Obama deported people.


 
The point is there is no hearing other than to sign a deportation order and informing the detainees of where they are going. There is no opportunity to ask for time to obtain a birth certificate proving citizenship or papers showing you are legally in the country, or a court order barring deportation until another issue is settled, and no chance to plea for for asylum.
I would call it a kangaroo court except that there is not court. As I said, it's a pick'em up, hold'em, and deport'em.
This is exactly how Clinton and Obama handled expedited removal.
Where was your outcry then?


 
If they get no due process, requesting a new card could be risky.
Green Card holders are LEGAL RESIDENTS and entitled to protection and due process under our laws as long as they comply with our laws and one of which is a requirement that they produce the Green Card upon demand.
 
To replace a green card you must file USCIS Form I-90. If you do not have a Social Security number which is half of green card holders, you must file an SS-5 to get a social security number. If your green card does not have a picture on it or it has changed you will need to get a passport picture for the green card. All of of this of course is being done from an ICE detention center. Given the short period between ICE detentions and deportation, you will be pleading your case at a US embassy which of course is a total waste of time because once you have been deported you are barred from re-entering the US.

The assumption is that once you have been deported, your case and all pleas have been heard. All relevant documentation has been examined leading the court to rule that you will be deported. Of course that assumption today is completely false.
So a holder needs to replace a lost one IMMEDIATELY.
 
Everybody crowing about due process rights......OK, Biden overwhelmed the courts with asylum hearings, now supposedly in excess of ten years..........That sure as hell sounds unconstitutional. Ten or more years to get a hearing?

In U.S. asylum cases, while there isn't a constitutional right to a speedy trial like in criminal cases, there are specific procedures and timelines for hearings. Asylum seekers can have their cases fast-tracked through expedited removal, but they still have the right to a review by an immigration judge within 7 days. The asylum process can be lengthy, with backlogs and delays often extending the timeline to several years
