Federal appeals court says Trump unlawfully invoked the Alien Enemies Act for deportations​

A divided federal appeals court on Tuesday said President Donald Trump’s use of the Alien Enemies Act to rapidly deport alleged Venezuelan gang members is unlawful and blocked its use in several southern states, issuing another blow to Trump’s invocation of the 18th century law.

The Fifth US Circuit Court of Appeals said in a 2-1 ruling that Trump cannot move forward with using the sweeping wartime authority for deportations in Texas, Louisiana and Mississippi. The president has not leaned on the 1798 law for removals since mid-March, when his invocation of it sparked the first in a series of legal challenges.

Tuesday’s ruling is notable because it’s likely the vehicle through which the issue will reach the Supreme Court for the justices to potentially review Trump’s use of the law in full.


Not a great week for Don so far. His takeover of LA was ruled to be illegal. His use of the AEA was ruled illegal. And his ankles got bigly.

You need to get updated. The Supreme Court just said the President has authority in LA to check people for citizenship.

They could ask themselves why they keep getting overturned lately. But they probably already know, even if you do not.

The reason is that during Trump's second term, these low level federal judges have appointed themselves gatekeepers of what donald trump is, or he is not allowed to do as the chief executive. Theconstitution of the united states does not give them that role.

I actually agree that the supreme court there should be more detailed in their explanations of why they are overturning these absurd rulings. My guess is that they want to spare the feelings of those low level judges by not commenting on how obviously wrong they're legal thinking has become.

That is a mistake. I say don't coddle them. explain why the latest antitrump ruling.It's not legally sound. They should try to avoid ending with "duh!"

Meanwhile, if you have a question about why a specific case was decided against the Stop Trump Movement, I'll be happy to explain it. Since I am not a supreme court justice, I cannot promise to leap out the "duh."
