First point. They legally are citizens and they do qualify for child support--sometimes a paternity test is required to get the deadbeat to pay.
Second, people with medical conditions are subject to incarceration all the time. More germain to the argument is the fact that a murderer of a pregnant woman is charged with TWO murders, not just the murder of the host. Research Scott Peterson and the murder of his pregnant wife, Lacey and their unborn son, Connor.
