ABC is still going to pay him. . . If this had happened at the end of the contract, the position that, "ratings were down, that is why he was canceled," might hold water. But given the facts that Hollie posted in that NYPost article, any intelligent person sees what is going on.

There is no reason the network would seek to purposely lose more money if it hadn't been for the regulatory corruption going on between Nextar and the FCC.

Yeah I mean the guy is not standing in any soup line anywhere. He's got enough I'm sure where he could simply just use his money to make more money. If he hasn't diversified up till now then he's even more stupid than I thought he was.

This is your standard corporate hide behind.
That overgrown, unfunny jackass pretending to be some kind of humorist was losing millions every year for the network. The network is a corporation and cooperations cut their losses.

I'm sure the issue of licensing also came up in whatever meeting they held.... But I'll give you dollars to donuts that they saw the golden opportunity to get done what they needed to get done anyway while blaming it on someone else.

And while we're on the subject if you've read the fcc's rules about general broadcasting I think the argument could be made that they're unconstitutional. Lying to the public is definitely a form of free speech. However being punished for lying is not illegal. The constitution enumerates rights but it doesn't protect against punishment.

By petitioning for and accepting the license, there is an agreement that certain speech is curtailed, such as those listed above, and intentionally misleading the public.

My free speech was curtailed in a very similar way by the government.

I signed a military contract with the government that curtailed my rights. I voluntarily signed away my right to certain speech and my freedom of movement. Had I violated that contract, the government of the United States would have placed my insubordinate ass directly into federal prison.

We have rights, but those rights can be curtailed VOLUNTARILY by contract with the government.

This is the case in this circumstance.

The government did not threaten Kimmel with any sanctions for his speech.

They threatened ABC with fines for violating the regulations of the voluntary licensing contract that ABC agree to.

Big difference.

Have you looked at his ratings? Worse than Colbert. SInce he started his left wing rants ten years ago, he's lost over 70% of the key demographic.

However, the decline is even more significant among the advertiser-coveted demographic of adults, ages 25-54.

I think he's also a victim of public boredom. Late night talk shows have more or less run the Gambit of their usefulness and are really no longer a sought after venue. Add to that the unsolicited infusion of political opinion and you have a recipe for failure.
