I would be surprised if this does not result in a mistrial with prejudice, and consequences for the prosucutors.
The latter half of that question was admittedly tongue in cheek.
 
The defense is letting this kid down by asking for a mistrial without prejudice.
The motion with prejudice is still being considered, though. I never heard the judge say he wasn't.

Bad move to ask without in open court though.

I assume they don't want to put him at risk of a jury convicting him based on personal political agendas or fear of the mob. To an attorney's mind, a sure walk is better than a possibility . . . and they're not entirely wrong.
 
They're thinking that their client is innocent and they want him to walk out of the courthouse free.
Of course they do.

But what's to say that the next jury won't face the same political pressure as this one?

That makes no sense. Rosenbaum was chasing him before he first pointed the weapon.
Rittenhouse pointed his gun at YellowPants guy, though there no indication Rittenhouse saw that. But then Rittenhouse did see him point his gun at Ziminski. And then of course, he saw Rittenhouse point his gun at him.
