It's distinct from asylum, as the standard for withholding is higher, requiring a demonstration that it is "more likely than not" the individual will be persecuted if returned) is illegal and harmful to the person that has that status, which Garcia has. It is impinging on the rights given to that person due to the status he was given by the existing laws that he followed.
