So you need both the element of creating the message, and transmitting it as a threat, saying that's what you intend, or to someone you know has the capabilities of carrying the command to fruition.

Yet it's a slow process to get a federal judge to give up his deference to the DOJ, that gives the DOJ and its lawyers the presumption of having great integrity to the law.

But under Trump this has been greatly eroded, by the lawyers with integrity being fired, quit, or being forced out. Leaving inexperienced, or unscrupulous lawyers as the only ones willing, or available to present baseless cases against Trumps enemies.
