The Justice Department could present a new indictment against James Comey to a grand jury as soon as this week, according to multiple sources familiar with the matter.

Whatever comes next may happen quickly, and no matter what, the sources told CNN, prosecutors will likely present new indictments against the former FBI director and New York Attorney General Letitia James to grand juries in the Eastern District of Virginia.

The previous cases against Comey and James were dismissed last week after a judge found that interim US Attorney Lindsey Halligan didn’t have the authority of a prosecutor when the indictments were returned in late September and early October. The Trump administration within hours announced they intended to appeal, though they haven’t done so yet. Internal strategy discussions since then appear to have pushed back that filing, one of the sources said.

Comey had previously pleaded not guilty to charges that he lied to Congress five years ago. James pleaded not guilty to mortgage fraud-related charges.

After the dismissals of their cases, FBI Director Kash Patel said over the weekend that “multiple responses” could come as early as “right after Thanksgiving” in the dismissed case against Comey."

Trump has been going after Comey since 2017 and so far Comey has no need for files or escape plans. Every case has been tossed.

McCabe sued the federal government and got his pension restored. Lisa Page and Peter Strocz sued and they received $2 million between them.

All Trump has done with his attempt to jail his enemies is cost the American people millions of dollars and waste taxpayers’ time and money.

How come you never start threads about the outcomes of any of these investigations and attempted prosecutions? Just big celebratory threads about an attempt to charge a decent man for doing his job.

I'm not sure how strong his case against the DOJ was originally on the malicious prosecution charges, but if they refile the charges against him again now, after the statute of limitations on bringing the charges against him are alleged to have lapsed (the reason they were rushing to get the charges filed and everything was so sloppy), then they'd just be handing him a cause against them.

The statute of limitations is not applicable because the charges were originally filed on a previous date and they were dismissed on a technicality, so the statute no longer applies to the new indictment.

Actually if a indictment is dismissed and the SOL has expired there is a 6 month extension of the SOL (from date of dismissal). The SOL doesn't get a "reset" with a whole new SOL (measured in years).

However, the legal issue that the defense will raise is that a valid indictment was NOT filed because the Acting US Attorney was not valid, she alone presented to the Grand Jury and she alone signed the indictment. Since her occupation in the position was voided, that means no valid indictment ever existed for an extension to apply. (Not saying they will win, but that will be their argument.)
