As an aside, Mueller was appointed by a Trump appointee only after Trump fired Comey in an effort to undermine the FBI investigation.

The Mueller prosecutor walked away because I am sure he does not want to appear before Sullivan again after Sullivan learned this lying, corrupt little weasel misled the court & withheld documents from both the Judge and the defense.

It's his decesion to grant or deny the motion made in his court.

And, if he denies the motion, and the U.S. Attorney refuses to proceed with the sentencing phase, then what?

It depends on what his rationale for denying the motion is , I guess. I would assume the DOJ would appeal to a higher court or seek to have the case moved to a new judge however that would work.

Forget being called before the DC Appellate Court, I would love to see USSC Justice Ginsburg, backed by CJ Roberts and the rest of the USSC Justices, call Sullivan to appear to before them and to explain why he believes the Justices who voted 9-0 several weeks ago are WRONG and why they should all overturn their votes. I would love to see him argue how his knowledge, intellect, and experiences are greater than that of the combined USSC Justices.

Even the Left's beloved Ginsburg is being tossed by the wayside in this case, as are the other liberal USSC Justices, because they and their precedent is getting in the way of Mad KING Sullivan going his own way....
