At that speed he was pushed by the car, not because he didn't have enough time to get out of the way, but because when he heard that revving engine he was reaching for his gun and trying to stand ground and lean in instead of simply getting out of the way.

DOJ guidelines are clear on this - don't approach the car from the front and do everything you can to get out of the way. Use of deadly force is ONLY permitted when you CAN'T get of the way and that is the only option available to prevent injury to yourself and/or others.

The shots fired though the side window at the head of the driver as the car was passing him OBVIOUSLY had nothing to do with defense, everything to do with trying to kill the fleeing driver.

Exactly. IF he was bumped by the car (and that is a big IF) it happened at low speed and was a glancing blow caused by him refusing to step out of the way as Depertment guidelines require.
