That is a weird statement
"if the Republican decide to pursue" so why would they not pursue it unless they realize that the optics could back fire on them or they cannot prove the case

"he may be in hot water if the IRS pursue this"

A lot of if , and, and but" from a former judge

So he is saying if they can prove the case, then no problem but if they cannot prove the case then it will backfire on them

Quite the dilemma but the base will be shouting "go for it".

Worse case scenario is if he become president then we will still attack him
