When you find a criminal with a gun, you arrest him, as intended by the law against criminals having guns.

I said that this law will help prevent the wrong people from getting guns. It will prevent selling guns to people with no questions asked. It makes selling a gun without a background check illegal. With the only exceptions being if it's between family members or it's an antique gun.

Using your logic, this law will catch 2 criminals instead of just one. With this law the police will be able to arrest the person who sold the gun to them without the background check. Right now anyone can claim they didn't know the person was criminal so they aren't held responsible for selling a gun to a criminal.

This law will stop many criminals from getting a gun. Right now they can walk into a gun show, go on line or buy from a friend with no questions asked. No one will stop them.

When this law goes into effect that will stop. So less of the wrong people will get guns and lives will be saved.

You seem to believe that trusting a criminal is a good thing to do. It's not. You seem to think that just anyone should be able to buy a gun whenever they want, no questions asked.

If I'm not mistaken (and I'm not) Colorado has background checks also. Didn't stop Columbine, Aurora, Arapahoe County from happening, now did it? Come to think of it - Colorado is full of hippies. Makes you wonder why there are so damned many murders in that "bastion" of liberalism.

The commerce clause clearly allows for regulating sales. The second amendment certainly allows for regulation.

How does the state prove that a gun was transferred illegally under this law? Hint: It can't.
Why? Because there's no mechanism in place that allows the state to prove when a gun was sold, who sold it and who bought it.

The biggest source of guns among criminals are those that are stolen from law abiding citizens. Period. Dealers are a small, insignificant source of such guns.

If you know how many were stolen then what will registering them do?

Well we would have to have background checks on all guns sales. Then you could track just how all the guns get into criminal hands. If a gun is registered to you and requires a background check you are much less likely to sell it to a criminal without a check because it can come back to you. Now you can sell a gun to whoever and as long as they can't prove you knew he was a felon they can't do anything. If the last owner was a dealer then it would come back to him.
