No. It isn't. Bear spray isn't as potent as pepper spray.
if a death is a direct result of that spray ... then it is a homicide no matter how you slice & dice it.
same as if the cop who suffered a heart attack after an insurrectionist tazed him... if he actually died, then that animal who did it .... was responsible for his death.
so when a cop pepper sprays a person and they die that is manslaughter?
depends on the circumstances - was the 'person' already in cuffs or actively engaged in a fight with the cop? was the cop threatened with his own bodily harm?
manslaughter - This classification of murder is the most susceptible to State interpretation.
