The Justice Department is part of the executive branch. It cannot be independent of the President and the President's powers.

The whole trope of it being independent is not based on the Constitution nor is it based in any Law.

No, it can't be. All power in the Executive flows from the elected President. The balance to the Executive is the Judiciary and the Legislative, not some bastard agency outside the triad.

It has always been an agency where the head is appointed but day to day operations are not controlled by the President.

Nixon usurped that and it was a big part of why he was forced to resign.
Trump is blatantly going after political opponents and anyone not sufficiently loyal to HIM.

All work done by the Executive is under the power of the President. It's why they have to appoint "special counsel" when things involve the Presidency. Even that should be handled only by the legislature to be true to the Constitution.

I'd like to think that assessment is too pessimistic. Whether it is will depend more on trumpery's lasting affect on the former GOP than anything else. If rank and file Repub voters continue to return folks like Gym Jordan, Mike Lee, and Jim Comer to Congress then it will prove to be correct.

Never in American history has any person been as persecuted and prosecuted ... and for no reason. Strictly political because Trump's the biggest threat to the Deep State and the creeping socialism/communism that the Democrats thirst for.

It will hard for the next President to unravel the mess he has made of the DOJ... They have gutted independent prosecutors and replaced with loyalists, each one trying to out do each other with more ludicrous prosecutions...

The next president is going to have a line of malicious prosecution cases to deal with... Comey looks like it will have to be settled, it looks ridiculous... Latifa James might have a payout... Jack Smith if it comes up is a certain payout...

There is no law to make them independent...

But I think the President not be able to claim executive privilege if he ordered a prosecutuion of an individual or group.

President orders it and it looks like selective prosecution from the start.

That is why previous Presidents don't get involved... Any interference could be argued as selective and the case is thrown out..
