Special Investigator stated that according to DOJ policy a sitting President could not be indicted or accused without being able to defend himself in court. Special Investigator's report laid out the facts of possible Obstruction episodes and left it to Congress to descide on formally charging the President.

Impeachment is a political process not a criminal process. The House draws up the charges and the Senate conducts the trial. Because impeachment is a political process the Senate makes the guilty-or not decision. With the Senate having a majority of Republicans it would be foolish for Democrats to pursue impeachment until the magical number of Republican Senators agree that they are not going to vote party party-line first.
