A new plan introduced by the state legislature Friday — with the backing of the governor — proposes a special law that would put in place state oversight over Disney’s Reedy Creek Improvement District, effectively ending Disney’s self-rule over its Orlando fiefdom where it has enjoyed numerous special privileges, including tax breaks, for five decades.

The measure would also prevent Disney from using taxpayer dollars to pay off the district’s outstanding debts and bond obligations.

The notice for the plan was posted on Osceola County’s official site, but the legislation would also impact Orange County since Disney operates in both counties.

“The corporate kingdom has come to an end,” DeSantis’ communications director, Taryn Fenske, said in a statement to Breitbart News. “Under the proposed legislation, Disney will no longer control its own government, will live under the same laws as everyone else, will be responsible for their outstanding debts, and will pay their fair share of taxes.”

She added: “Imposing a state-controlled board will also ensure that Orange County cannot use this issue as a pretext to raise taxes on Orange County residents.”

Gov. DeSantis will have the power to appoint members to Reedy Creek’s oversight board if the bill passes, sources told Fox News.
While Desantis seems to be fairly good at doing this in Florida, the US federal government has different laws. While he could have some influence if he were to become president, could he really do the same thing as president that he is doing in Florida?
 
Disney will be around long after DeSantis is gone and forgotten. And now that the county tax payers have to pick up the tab for $2 billion taxes, and pay for their own fire, and police. I'm sure thats going to work out real well next election.

Now, let's go to a real news outlet for an analysis of why this isn't going to happen.

The Contractual Impossibility of Unwinding Disney’s Reedy Creek​

Much ado has been made about the legality of Florida’s Senate Bill 4C purporting to dissolve Disney’s Reedy Creek Improvement District: whether it was retaliation prohibited by the First Amendment, whether it was passed with sufficient formality, and so on. But there’s a much more basic reason Florida can’t dissolve Reedy Creek—it promised bond purchasers that it wouldn’t.

Reedy Creek, like other special districts, can borrow money by issuing bonds, which can then be purchased by investors looking for fixed payments. Just like any other debt, the terms of the bond are based on the specific bond contract at issue. Reedy Creek is authorized to issue a few different kinds of bonds, but the most important ones are those that promise to pay from the property taxes collected by the district and those that pay from utility system revenue.

In authorizing Reedy Creek to issue bonds, the Florida legislature included a remarkable statement—included in Reedy Creek’s bond offerings—regarding its own promise to bondholders: “The State of Florida pledges to the holders of any bonds issued under this Act that it will not limit or alter the rights of the District to own, acquire, construct, reconstruct, improve, maintain, operate or furnish the projects or to levy and collect the taxes, assessments, rentals, rates, fees, tolls, fares and other charges provided for herein … until all such bonds together with interest thereon, and all costs and expenses in connection with any action or proceeding by or on behalf of such holders, are fully met and discharged.”

The bill dissolving Reedy Creek doesn’t say what should happen to these debts, but another statute does: By default, the local general-purpose government—the county—assumes the district’s debt, along with all of its assets. This means that theoretically, Orange and Osceola counties will inherit upward of $1 billion in bond debt.

Both the U.S. and Florida constitutions place strict limitations on the government’s ability to impair its own contracts. Under the U.S. Constitution, a state can only impair an existing contract if the impairment is reasonable and necessary to serve an important government purpose. As early as 1866, the U.S. Supreme Court held that once a local government issues a bond based on an authorized taxing power, the state is contract-bound and cannot eliminate the taxing power supporting the bond. The Florida Constitution provides even greater protection from impairment of contracts.

Well an update. It seems that DeSantis actually lost this one.


It seems that Disney put Covenants in place to insure they had total control of all their property.


And those are in effect until 21 years after the death of the grandchildren of King Charles of England.

And let’s not forget the $1 Billion debt the State saddled the local counties with.


If this is what DeSantis calls a win, I’d hate to see what a loss looks like. I’m sure it would involve the eradication of a significant part of Florida.

Now I’m going to be honest. I think that Disney will eventually lose in court. But it will cost Florida a couple billion dollars at twenty years of lawsuits. At least.

Disney has Lawyers on staff. They’re salaried employees. They are going to get paid no matter what. So Disney’s budget in this is already planned for every year.

In one article I read the Council has begun lining up law-firms. Plural. Many law firms. Everyone there charges by the hour. And you are going to need them to argue every single line of the agreement. And every bit of it will be litigated in every court from Orlando to the Supreme Court.

With delay tactics and motions, and appeals to the motions, the entire process will take at least twenty years. People on the board now, will retire before they get to exercise any power over Disney.

Year after year Florida will be paying lawyers. Just for this. Just to research and write responses.

I have long argued that it is cheaper to sentence a guy to life in prison than to sentence him to death. The death takes ten to fifteen years or more. And all that time you are paying lawyers on both sides to file and fight the appeals. Tens of millions of dollars that could be spent on other things.

Compared to this, that wasted money is going to look like a poor guy buying a lottery ticket. The suit against Disney is going to be a line item in the Florida State budget for decades.
