PORTLAND, Ore. — An Oregon man filed suits Monday claiming Dick’s Sporting Goods and Walmart discriminated against the 20-year-old when they refused to sell him a rifle.

Dick’s and Walmart restricted gun sales to adults 21 and older in the wake of the Florida high school massacre. The 19-year-old accused in the school slaying bought the AR-15 used in the attack legally.

Oregon law allows residents to buy shotguns or rifles starting at age 18.

Watson is asking judges to force Dick’s and Walmart “to stop unlawfully discriminating against 18, 19, and 20 year-old customers at all Oregon locations.” Additionally, he is asking for unspecified punitive damages.

IOW--if wedding cake and pizza joints can refuse service to gays and get away with it, I would presume that Dick's sporting goods and Walmart &-(since they are both national companies) located in more than one state can refuse service on all gun sales to people under 21, regardless of Oregon state law.

You have to be 21 years old in this country to qualify for purchase of a handgun. Is that discrimination? AR-15's AK'S & others are not classified as military assault weapons or semi-automatics, they are simply classified as "rifles."

Walmart is in violation of Oregon State Law. This is a good thing. Win or lose, the challenge is good.

Wouldn't Hertz, and Avis, and Alamo, and all the other car rental places also be in violation, since they don't rent to people under 25 years old.

Edited: At least not without a young driver surcharge, and they absolutely don't let anyone rent under 21 years old.

It doesn't matter if they have a state law, the U.S. Constitution will always "TRUMP" state law. IOW--if this got as far as the U.S. Supreme Court--the Oregon law would be overruled. Business's can refuse service to anyone they choose, as long as it's not about race or color. The second issue with this is that they are both national corporations, and therefore not necessarily controlled by a single state law. This kid better have some deep pockets to take on these two--

Car rental companies have to rent to someone under 25, the person renting needs to pay for the extra cost of the insurance. They are not allowed to discriminate based on age.

I was denied a car rental when under 21.....this was long ago, and paying higher insurance price was not an option.....

Maybe states are different?

So you are saying if the driving age is 16 in the state, the car rentals have to rent to them???

A 16 year old can't legally enter into a contract, unless they are an emancipated minor and given contract rights by a court.

The difference is that a baker is an artist, and as such has to craft the item desired by the customer.

That's incorrect. The gay couple didn't ask the baker to create a unique cake, they simply ordered a cake that the baker already makes, they didn't ask for anything additional or creative. Basically, they ordered a product.
