That is exactly why it isn't often used or prosecuted. It has to be a pretty well-known law that the order is in violation of and the the GI that refuses it is open to prosecution on a number of violations. The whole video was a dog whistle as is the threat to prosecute the six congressmen. Nothing burger on both counts.

But the 6 were reminding the BRASS they are required to disobey UNLAWFUL orders.....not the service members.

The only reason this is an issue, is because Trump had many if not all of the top Brass expert legal beagle advisors, JAGS removed or fired....so they could not advise with expertise the commanding officers.....on lawful vs unlawful with any expertise, is what was reported....or the trump admin lawyers are over riding the military legal beagles is also being reported.....BEFORE they created the video released.

It's the commanding officer that must refuse to send their men in.

OK. Would your officers have obeyed your order to dishonorably discharge any sailor that refused to take the COVID shot because of his religious beliefs? Would you have made such an order?
No, I did not train my command anything. The military trains it's troops to follow the orders of the officers appointed over them. It is in the oath for all service members.

Your comments are mutually exclusive as the second contradicts the first.

Those orders came from the Commander-in-Chief of the military and was not an illegal order. I was subject to that same order as I was working for the US Army as a civilian at that time. Had I not gotten the shot, I would have been fired. It was not mine or anyone else's authorization to determine that was an illegal order, because it was not.

You are trying to use examples that do not fit the scenario.

The courts just reaffirmed, if a commanding officer sent the military in to perform law enforcement duties, it would break the Posse Comitatus Act, be an unlawful order....with just a couple of clear exceptions.
