I'm pretty sure dismissal without prejudice does not extend the SOL.Again no. Once an indictment is filed it stops the clock for six months. But it won't save the case here. There's about a gazillion other problems with it. Much more severe ones that will get it dismissed with prejudice.
It doesn't matter in this case, trump appointed an acting attorney for a limited amount of time...he does get that ONE leeway, until he can get one through the senate, but it is a limited time period or if the attorney the president appoints as an acting resigns, he does not get a second choice or chance, the district judges gets to pick, the next acting.....I'm going to ask you a question you will not understand.

Sorry to say this but you are wrong in this case. The indictment was filed before the statute of limitations expired this stops the clock for six months so they can theoretically refile under a different United States attorney. Doubtful they will but that's how it is.It simply can not. They can not go before a grand jury, for an alleged crime that is past the statute of limitation where charges can be brought....they can't change today's date back to the last day he can be charged. ALL prosecutors and lawyers KNOW and SAY this as a fact of law.....and it is a fact, it is too late, they waited too long.
Federal law has a 5 year statute of limitation,
with the exception of very serious crimes like murder, and treason having NO Statute of limitation.
