It's doubtful though in my opinion. If for no other reason that this indictment is such a shitshow that Halligan is risking sanctions. And I doubt she'll find a prosecutor to be counsel of record here.

This also assumes the other motions still pending are not granted.
 
Based on the appointment clause. The criminal charges were not dismissed which means that they can still be prosecuted.
The problem is that the statutes of limitation have now run out to file the charges and indict and that puts Comey pretty much in the clear.

They made sure of that before petitioning the judge to throw out the case which I'm sure was likely deep state controlled.

So much for justice. We really cannot expect a lot of it until the deep state is eradicated.

Again no. Once an indictment is filed it stops the clock for six months. But it won't save the case here. There's about a gazillion other problems with it. Much more severe ones that will get it dismissed with prejudice.

The ability to appoint an acting US attorney was delegated to the president under certain circumstances. There is no constitutional authority for the president to appoint an acting US attorney.

It simply can not. They can not go before a grand jury, for an alleged crime that is past the statute of limitation where charges can be brought....they can't change today's date back to the last day he can be charged. ALL prosecutors and lawyers KNOW and SAY this as a fact of law.....and it is a fact, it is too late, they waited too long.

Federal law has a 5 year statute of limitation,

with the exception of very serious crimes like murder, and treason having NO Statute of limitation.
