Since the events at the Capitol on January 6, there has been a lot of discussion of the terms sedition, insurrection, and treason. But what are the legal definitions of these three acts, and how are they different from one another?

Insurrection

insurrection involves actual acts of violence against the state or its officers.

Only the attorney general can bring charges of insurrection, which is defined by Title 18, section 2383 of the U.S.C.:

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

Elsewhere (title 10, chapter 13, section 254), the U.S. Code allows the president to “immediately order the insurgents to disperse and retire peaceably to their abodes within a limited time.” If the insurrectionists don’t comply, the president can then call out the military and National Guard to suppress civil disorder and insurrection.

We're talking about her specific situation. A mob of hundreds broke into the Capitol, threatening lawmakers. The House chamber had not yet been completely evacuated when the mob started breaking into the House chamber with lawmakers still inside. The first person to try to gain entry was shot and killed which kept the mob out until lawmakers were safe.

That cop is a hero and Ashli Shootingtarget died a traitor to her country.

They first claim it's justified to use lethal force when it's one or more police officers, against a single unarmed assailant.

But it's not justified when it's lethal force against individual members of an armed mob of hundreds, against a small outnumbered police force defending the people the mob intends to assault.
