Didn't have to. If he merely went to the Capitol and stood around outside, he broke no laws and should not have been arrested. Called as a witness maybe, but not arrested. Heck, he could have even said to a passerby that he wished TRUMP! had clearly won the election and broken no laws. Let's get real extreme here and say he could have publicly stated that he even VOTED for TRUMP! and broke no laws. So there's that.
