By a new president

A sitting president can revoke, amend, or replace any executive order, including those from their predecessors, through a new executive order.

I don't think the courts (any courts) would touch the issue of executive order signed by autopen.

Since the current president can affirm or rescind any previous executive order. Why would the courts weigh in on something that has a simple political solution.

The pardon power is something the courts would have real trouble with. Since a presidential pardon doesn't even require the president sign it.

What you didn't say is that by having real trouble with it, they would punt it out of court.
As in this case the courts have no remedy. Thus the plaintiffs have no right to take it to court.
