As pointed out, Barry declared he had no Consturutional authority to affect citizenship...right before he issued the DACA EO.

DACA was created in a 2012 memorandum issued by former Department of Homeland Security Secretary Janet Napolitano. The program does not grant legal immigration status to its beneficiaries, but it does protect them from deportation and allows them to apply for work permits and a Social Security number.

These protections and benefits are provided in two-year renewable intervals.

To qualify for DACA, a person must have arrived in the U.S. before their 16th birthday and before June 15, 2007. Immigrants are ineligible for the program if they have been convicted of a felony, a significant misdemeanor like domestic violence or sexual abuse, or three or more misdemeanor offenses. They also cannot be deemed a threat to national security or public safety.


All of that is well and fine. But it was never voted on by Congress.. Now that the Democrats have majority in both houses and a Far Left Presbo, why don't they put it to a vote?

Wednesday's ruling by three judges of the New Orleans-based 5th Circuit upholds the judge's initial finding. But it sends the case back to him for a look at a new version of the rule issued by the Biden administration in late August.

The new rule's 453 pages are largely technical and represent little substantive change from the 2012 memo that created DACA, but it was subject to public comments as part of a formal rule-making process intended to improve its chances of surviving legal muster.

If it were that simple the court wouldn't have to find some administrative technically to call it illegal. That technically has been corrected which is why it was sent back to the original judge.
