Section 1324 title 8 says it's a federal felony to encourage illegals to live here. So we knew back in 2012 that the Kenyan's EO establishing DACA was illegal. It should have been struck down then.

The U.S. Court of Appeals for the 5th Circuit upheld a lower court ruling that found the Biden administration’s attempt to codify DACA violated U.S. immigration law.

The decision affirms that the 2012 Obama-era memo, which unilaterally created DACA without congressional approval, was both unconstitutional and a blatant overreach of executive power, CBS reported.

The reason it wasn't was because the Trump administration was either too lazy to do it the right way or never actually planned to do so the start with.

At the oral argument last November, the main issue before the Supreme Court wasn’t whether the Trump administration has the power to end DACA, because everyone agrees that it does. Instead, the question was whether the administration went about it in the right way.

As some remember, Trump had a plan for DACA to also stay in America. It was a huge number of people. More than the Dems wanted. So, I think we will see the laws re-written for those who have live here pre Obama years.

In retrospect, I think that he proposed that knowing that Piglosi and Chuck U would reject it...He knew that they were all in favor of it a few months prior.
