Second, the Constitution still says, the right of the people to keep and bear arms shall not be infringed.

If you changed the whole thing to say, "The National Guard, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed", it still says, the right of the people to keep and bear arms shall not be infringed.

The first claim is that all rights have a corresponding obligation so the 2nd Amendment isn't valid unless you serve in the militia. What's the corresponding responsibility that goes with the 1st Amendment? And the 4th? And the 15th? And even the 13th?

The responsibility for all rights is to live a law-abiding, patriotic, responsible life, taking responsibility for your own life and that of your families, not being a burden on others, and keeping a close watch on government and doing all in your power to prevent government overreach.

Next, it argues that the individual cannot ignore their duty to serve in the militia - and no one is arguing that. If the Government abdicates its duty to train and organize the militia doesn't remove the right to keep and bear arms. It doesn't remove the constitutional requirement that the militia is necessary to the security of a free state.

The Congress and the State both have legal authority in the training and regulation of the militia. They should exercise that authority. They should do as Tench Coxe did and actually acquire guns from the Federal Government for those who could not afford them. AR-15s for all able-bodied men, age 18 to 60. In fact, though, they should be M-4s but the AR is close enough for training purposes.

The failure of the Congress and the State to fulfill their obligation does not remove the right of the people to keep and bear arms. In fact, it could very well be that the Congress' plan is to call upon the militia when needed for insurrection or invasion and that their plan is not training. That's their right and authority. If they training plan is not to train, so be it.

But when someone invades the US, they will need the armed militia to defend our nation. If the population is disarmed, then defending our nation is not an option. Congress cannot remove the option of using the militia to defend our security because the Constitution still says that the militia is necessary to our security. It's a constitutional requirement that can only be changed by amendment.

Next, the article attacks the oft-quoted gun rights outlined in the State Constitution of the State of Pennsylvania: “The freemen of this commonwealth and their sons shall be trained and armed for its defence under such regulations, restrictions, and exceptions as the general assembly shall by law direct.”

That the training and arms directed by the general assembly are none does not remove the fact that the freemen and their sons will be armed for the State's defense. In fact, the article quotes, but tries to twist in bizarre fashion, “the people have a right to bear arms for the defense of themselves and the state.”

The people have a right to bear arms for the defense of themselves.. Not in defense of their neighbor or the police in defense of the community but, instead, for defense of themselves. How they think they can twist this to remove the individual right is beyond my imagination but that's what this article is arguing.

Then there's this one: Scribble Scrabble, the pen name of an influential polemicist in Massachusetts (it was common for prominent men to write pseudonymously), echoed this prevailing logic when he held that the Massachusetts “Bill of Rights secures to the people the use of arms in common defense.” As for the individual right to bear arms, it existed, Scribble Scrabble maintained, it “being a natural right, and not surrendered by the constitution” — unless and until the “legislature shall think fit to interdict.”

Unfortunately for the Anti-Gunners, that whole legislature-shall-think-fit-to-interdict thing didn't actually make it into the Constitution and the shall-not-be-infringed thing did. The writings of the Founders, both for and against what we believe are our rights, are interesting and should always be considered in trying to understand original intent but, in the end, and considering those writings, it is what actually made it into the Constitution that counts and it is the original intent of that in which we are concerned.

Then there's the claim that Madison authored gun control legislation that didn't pass in Virginia making it illegal to carry your gun off your property except for military use. I've never heard that but I'll take it as fact and argue that the article lies in suggesting that Madison wrote the Bill of Rights alone; every word in the Bill of Rights was argued and changed many times before Congress submitted it to the States and the States ratified it.

Now let's talk about that whole prerequisite thing. As Political Chic already stated, is it required that patents and copyright only apply to science and useful arts?

Plus, the prefatory clause doesn't at all say that the right to keep and bear arms only applies to the militia. If that were their intent, the amendment would say something like "A well regulated Militia, being necessary to the security of a free State, the right of the militia to keep and bear arms shall not be infringed."

By the way, that's another thing. If the National Guard were the militia, which it clearly is not, and if the Amendment only secured, but does secure, the right to KEEP and BEAR arms to the militia members, then all National Guard members must be permitted to keep the National Guard arms with them. But it doesn't say that at all, so don't worry.

What the prefatory clause actually says, is that a well regulated militia is necessary to the security of a free state. What that says is that the government cannot get rid of the militia; it's constitutionally required to exist. And trying to merge the militia into a standing army is not the militia; it's a standing army. And we all know how the Founders felt about standing armies. So, no, no honest person could ever pretend that the dual enlistment into the Guard and the standing army is at all constitutional.

WASHINGTON (AP) — More evidence is emerging in the House's Jan. 6 investigation that lends support to recent testimony that President Donald Trump wanted to join an angry mob that marched to the Capitol where they rioted, a committee member said Sunday.
“There will be way more information and stay tuned,” said Rep. Adam Kinzinger, R-Ill.
The committee has been intensifying its yearlong investigation into the attack on Jan. 6, 2021, and Trump’s efforts to overturn the 2020 election. Rep. Liz Cheney, R-Wyo., the committee's vice chair, is making clear that criminal referrals to the Justice Department, including against Trump, could follow.
At least two more hearings are scheduled this month that aim to show how Trump illegally directed a violent mob toward the Capitol on Jan. 6, and then failed to take quick action to stop the attack once it began.
The committee also has been reviewing new documentary film footage of Trump’s final months in office, including interviews with Trump and members of his family.
